Emociones en la conciliación

It is necessary to integrate new knowledge into the conciliation, which will serve to strengthen and support when solving a conflict, through certain disciplines such as emotional psychology where its role will be of great importance, since it is quite common that the parties arrive emotionally and sentimentally affected. The purpose this work will be to integrate some methods such as cognitive behavioral therapy, integration and knowledge to the field of law. The objective of these three alternatives will allow us to identify and modify thought patterns and erroneous behaviors that are generally caused by emotions.
To achieve this, it is necessary for conciliating lawyers to know some approaches that psychology offers such as those mentioned above, so that later they practice their knowledge in a hearing. In this way, they will know how to identify if the conflict is real or more emotional. And if they are able to observe the central problem, they will know how to guide them when they can become aggressive, feel stress or fear due to pressure from the other party.
Taking all this into account, it is observed that social conflicts can arise for any reason, such as ignorance and misuse of emotions, therefore it is relevant to clarify that the law is not only a squared or hermetic social science that only allows strict criteria, since it is true that the law is also responsible for sanctioning behaviors that come from emotions, for this reason it is not incongruous to go to psychology as an aid to the law.
Es necesario que en la conciliación se integren nuevos saberes que servirán para fortalecer y apoyar la conciliación a la hora de solucionar algún conflicto a través de ciertas disciplinas como la psicología emocional, donde su rol será de gran importancia, ya que es bastante común que las partes lleguen emocional y sentimentalmente afectadas. El propósito de este trabajo será entonces integrar algunos métodos como la Terapia Cognitivo Conductual (en adelante TCC), la integración y el conocimiento emocional al campo del derecho. El objetivo de estas tres alternativas permitirá identificar y modificar patrones de pensamiento y conductas erróneas que generalmente son causadas por las emociones.
Para lograr esto, es necesario que los abogados conciliadores conozcan algunos enfoques que brinda la psicología para que después practiquen su conocimiento acerca de esta área en una audiencia de conciliación. De esta forma, al estar preparados y capacitados, sabrán identificar si el conflicto es real o es un conflicto irreal y más emocional ya sea a causa de problemas en la comunicación o interpretación, etc. y de estar forma al observar el problema central, sabrán cómo orientarlos cuando se pueden tornar agresivos, sientan estrés o miedo por la presión de la otra parte.
Teniendo en cuenta todo esto, se observa que los conflictos sociales pueden surgir por cualquier razón, como el desconocimiento y mal uso de las emociones. Por ello es relevante aclarar que el derecho no es solo una ciencia social cuadriculada ni hermética que únicamente permite criterios estrictos, pues también es cierto que el derecho se encarga de sancionar conductas que provienen de las emociones. Por esta razón no resulta incongruente acudir a la psicología emocional como auxiliar para el derecho.
