El artículo tiene como propósito analizar la memoria como espacio de reconstrucción del pasado, orientado hacia la reivindicación de las víctimas; y como su derecho legítimo, relacionado directamente con el ejercicio y goce del derecho a la verdad, de manera que permita superar los escenarios de violencia y violación de las normas internacionales de derechos humanos. Para ello, el acuerdo de paz y su implementación deben garantizar espacios para la reconstrucción de la memoria histórica del país, considerando los daños y el sufrimiento padecido por millones de víctimas que ha dejado el conflicto armado en Colombia. En esa medida se plantea la memoria como una estrategia que permite la conciliación y la convivencia en procesos transicionales que buscan la paz. En ese orden de ideas, se expondrá la evolución y desarrollo jurídico de la memoria en el campo internacional y dentro del panorama colombiano con relación al acuerdo de paz.
The trial article aims to analyze memory as a space of reconstruction facing the vindication of victim’s past, and as a legitimate right directly related to the exercise and enjoyment of the right to the truth of thosethem, so to overcome the scenes of violence and violation of international Hhuman Rrights standards violation. To do this, the peace agreement and its implementation must guarantee spaces for the reconstruction of the historical memory of the country, considering the damage and suffering endured by millions of victims who left the by armed conflict in Colombia. To that extent, the memory is proposed as a strategy that allows reconciliation and coexistence in transitional processes seeking peace. In that order, evolution and legal development of memory in the international arena and within the Colombian panorama regarding the peace agreement will be discussed.
